December 4, 1876

In the name of God Amen. I Henry Conkle a citizen of Marshall County 
West Virginia for many years and being of sound mind and memory do make 
ordain and publish this my last will and testament as follows to wit:
1st I will and devise that my wife Elizabeth Conkle have a comfortable 
living out of my estate both real and personal so long as she may live.
2nd I desire that all my just debts and funeral expenses be paid by my 
executor hereinafter named out of my personal estate if there be 
sufficient for that purpose.
3rd I will and devise to my son Richard Asbury Conkle all my estate both 
real and personal including my home farm, where I now live to be his 
own in fee simple forever upon this condition however that my said son 
Richard Asbury out of my said personal and real estate pay all my just 
debts and funeral expenses & further that he support his mother in a 
comfortable manner so long as she shall live further that out of my 
said real & personal estate my said son Richard Asbury shall pay to my 
sons & daughters the following legacies which I do here bequeath to 
them as follows to wit: To my daughter  Martha ward five ($5) dollars: 
to my son Benjamin Conkle five ($5) dollars: To my daughter Margaret 
Ward five ($5) dollars: To my  son Peter Conkle five ($5) dollars: To 
my daughter Angeline Lutes fifty ($50) dollars: To my son Henry Conkle 
five ($5) dollars: To my son James K. P. Conkle two hundred ($200) 
dollars & to my son Silas Wright Conkle two hundred ($200) dollars none 
of the foregoing legacies are however to be paid by my son Richard 
Asbury for two years after my death.
4th I do hereby appoint my son Richard Asbury Conkle Executor of my last 
will & testament hereby revoking any & all wills by me heretofore & any 
time made. In testimony whereof I have hereunto set my hand & seal this 
fourth day of December in the year AD 1876.

Signed sealed published and declared by Henry Conkle the testator as & 
for his last will & testament in the presence of us who in his presence 
and at his request & in the presence of each other have hereunto 
subscribed our names as witnesses this fourth day of December 1876.

West Virginia Marshall County Court. September 16th 1884.
A paper writing bearing date on the 4th day of December 1876, purporting 
to be the last will & testament of Henry Conkle late of this County, 
Dec'd. was this day fully proved by the oaths of Thomas F???? & L. J. 
Helms the two subscribing witnesses thereto & is ordered to be 
recorded. And R. A. Conkle the executor in said will named who made 
oath thereto & together with J. W. Gallaher his surety who qualified as 
to his sufficiency entered into & acknowledged their bond in the penal 
sum of one thousand dollars conditioned & payable as the law directs. 
Therefore certificate is granted the said R. A. Conkle for obtaining a 
probate of said will in due form.
