PETITION of W. E. SHEPHERD on behalf of WORKMAN CHILDREN Submitted by Linda Ross. (*This is an incomplete document - See note below) Of Marshall Co, W.Va. The petiton of W. E. Shepherd, guardian of Florence Workman, infant eight (8) years of age and John Workman, infant ten (10) years of age, and infant children of Blanche Workman, deceased, respectfully shows unto your Honor, that Hannah Crow was in her lifetime seized and possessed in fee simple of the title to a tract of fifty (50) acres, more or less, of land herein after more particularly described, and being so seized and possessed sometime in the year 1897, departed this life, intestate, leaving surviving her Henry Crow, her husband, and Rhoda White, (nee Crow), wife Joseph White; Angelina B Sibert, (nee Crow), wife of Joseph F Sibert; Sarah Clark, (nee Crow), wife of John Clark; Susan E Workman, (nee Crow), wife of Eli Workman; Maggie Sibert, (nee Crow) wife of Riley Sibert; Amanda Crow; John R Crow; William Crow; Florence Powell, (nee Crow), and Blanche Workman, (nee Crow) wife of Simon Workman, her only children and heirs at law to whom the title to said land passed and descended in fee simple, by inheritance, subject to an estate by the curtesy of said Henry Crow therein. That there were ten (10) children born unto said Hannah Crow and Henry Crow, which were and are their only children. That the said land is the same which was conveyed unto said Hannah Crow, in her lifetime, by two deeds, the first of which was made and executed to said Hannah Crow by Daniel McCardle and wife bearing date on the 5th day of January, 1886, and is recorded in the clerk's office of the County Court of said Marshall County, West Virginia, in Deed Book No. 47, at page 493; copies of which said two deeds are filed here with as parts hereof marked Exhibits No's. "A" and "B", respectively. That Blanche Workman was in her lifetime seized and possessed of the undivided one-tenth of the remainder in fee in said land, subject to an estate by the curtesy of said Henry Crow therein, and being so seized and possessed sometime in the year 1901, departed this life, intestate, leaving surviving her said Simon Workman, her husband, and said Florence Workman and John Workman, said infants, her only children and heirs at law to whom the title to said undivided one-tenth (1/10) interest in said land passed and descended fee simple, by inheritance, subject to said curtesy interest of Henry Crow therein, and also subject to the curtesy interest of said Simon Workman therein should he survive said Henry Crow. That said widow, at the time of the death of her said husband, became entitled to, and is now by law entitled to dower in said real estate, which has not been assigned or allotted to her. That since the death of her, said husband she has intermarried with. That the said children and heirs at law of the land Blanche Workman deceased, are the owners in fee of the undivided 1/10 interest in said tract of land, hereinafter described, subject to the curtesy interest or estate of said Henry Crow therein, and also subject to the curtesy interest or estate of said Simon Workman therein, should he survive said Henry Crow. That each of the said infants are the owners in fee of the undivided 1/20th interest in said of Hannah Crow, deceased, land, and that the said adult children, are each entitled to the undivided one-tenth interest in said tract of land, subject to the curtesy interests aforesaid. That said petitioner, on the 15th day of June 1903 was, by the clerk of the County Court of said County, duly appointed and qualified as said guardian of the said infants and is now their illegal and lawful guardian. Office copy of said appointment marked Exhibit "C" is herewith filed as a part hereof. That said tract of land is the only real estate, or interest in real estate owned or claimed by said infants, and that the personal property owned and claimed by said infants will not exceed $100.00 in value. That said tract or parcel of land is situated in Meade District, Marshall County, West Virginia. and is bounded substantially as follows, to-wit; On the North by the lands of.. Alex Chambers and others On the East by the lands of.. Jake Bassett and others On the South by the land of.. John Capper and others On the West by the land of.. Barney Sibert and others Containing, Fifty (50) acres, more or less State Of West Virginia, Marshall County, SS: Levi Smith, who is know to me to be a credible person, being first duly sworn, on his oath says, that he served the within notice on the within named Maggie Sibert on the 16th day of June, 1903. by delivering a copy thereof in writing, in person, to her in Marshall County, said state. That he also served the within notice on the within name Riley Sibert on said 16th day of June, 1903, in said county, by delivering a copy thereof in writing to Maggie Sibert, a member of the family of said Riley Sibert, and above the age of 16 years, and explaining to her the purport thereof, at his usual place of abode in said county, he the said Riley Sibert not being found thereat, or else where found by me. And on the within named Martha E Crow, on the 17th day of June, 1903, in said County, by delivering a copy thereof. in writing, to John R Crow, her husband, a member of her family, and above the age of 16 years, and explaining to him the purport thereof, at her usual place of abode in said County, she the said Maggie E Crow not being found thereat, or elsewhere found by me. And also on the within named Joseph White on the 17th day of June, 1903, in said County, by delivering a copy thereof, in writing, to Rhode White, his wife, a member of his family and above the age of 16 years, and explaining to her the purport thereof, at his usual place of abode in said County, he the said Joseph White not being found thereat, or elsewhere found by me. In reviewing the paper writing, it appears to be a part of something else. This merely recites the various interests, including the two infants, in the 50 acres. Normally, one would ask that the Court sell the property in lieu of partitioning because it is of such small value and probably not sufficient to partition and split between the various heirs. Anyway, it's an incomplete pleading, at best. There are no prayers for relief sought, etc. It contains a typo, as one of the final paragraphs refers to the guardian as illegal", whereas I'm sure they meant "legal". It does identify the heirs, which serves as genealogical material.
