Marshall County Will Book 1, Page 293

   In the name of God Amen. I William Dougherty Sr. of the county of 
Marshall and state of Virginia being of sound and disposing mind and 
memory do make and publish this my last will and testament. To wit:
   
     Item 1st   I demit that my funeral expenses and last debt be fined 
out of the first monies which that come into the hands of my executor, 
as soon after my death as possible from any fortune of my estate by 
this will to be sold, real or personal.
     Item 2nd    I also demit that a valuation or appraisement be made 
of all my personal estate by three judicious neighbors and after being 
singed with their names that a copy of the same be given to my 
executor.
     Item 3rd   I will and bequeath to my wife Nancy all of my real and 
personal property during her natural life and she longer, in lien and 
instead of dowry.
    Item 4th   I will and demit that all my real and personal property 
after the death of my wife should she survive me, shall be equally be 
divided between my three daughters, to wit: Nancy, Katy and Lovina, by 
the said three daughters paying the following heirs the bequeaths left 
them severally. To be paid according to age that is to say the oldest 
first and so on, until the youngest, one annually until all is paid to 
commence one year after the property comes into their possession. 
     Item 5th   I bequeath to my son John ten dollars.
     Item 6th   I bequeath to my son William ten dollars.
     Item 7th   I bequeath to my son Robert ten dollars.
     Item 8th   I bequeath to my daughter Elizabeth ten dollars.
     Item 9th   I bequeath to my daughter Mary ten dollars.
     Item 10th I bequeath to my daughter Margaret ten dollars.
     Item 11th I bequeath to my son Henry forty dollars.
     Item 12th I do make creditable and appoint John Winters executor of 
this my last will and testament hereby revoking any and former wills by 
my hand at any time.
     In witness when I William Dougherty the stator have him unto set 
my hand and seal to this my last will and testament written on one 
sheet of paper this 17th day of April in the year of our Lord 1856.

County Court of Marshall County. August term 1862. A writing reporting 
to be the last will and testament of William Dougherty late of this 
county, was this day fully proved by the oaths of Albert Davis and 
James Campbell, two of the subscribing witnesses hereunto, and was 
ordered to be recorded. And on the motion of John Winters, the executor 
named in said will. Who together with Albert Davis and James Campbell 
his witness who qualified to this sufficiently, into and acknowledge a 
bond in the penalty of $2000 payable and creditable as the law demits, 
certificate is granted the said John Winters for obtaining a probate of 
said will in due form.
