Will of Hanson Davis, 1808-1876 Written 15 February 1871, Probated 1 Aug 1876 Marshall County WV Will Book 2, pages 60-1 In the name of God, amen. I, Hanson Davis of the County of Marshall and State of West Virginia, being of sound and disposing mind and memory do make and publish this my last will and testament. Item First. I will and direct that all my just debts and funeral expenses be paid out of the first money that shall come into the hands of my Executor or Administrator as soon after my decease as possible from any portion of my estate by this will ordered to be sold, real or personal. [No Item Second.] Item Third. I will and bequeath to my son Albert G. Davis the east half of the farm that I now own and live on by the said Albert G. Davis paying the following named heirs their portion of any money that I bequeath unto them, that is to say: My daughter Nancy Craft four hundred dollars; my daughter Mary Daugherty four hundred dollars; my son Isaac W. Davis four hundred dollars, and to my daughter Sarah Jane Turner one hundred and fifty dollars as their portion of my real estate. Item 4th. I will and bequeath unto my son John Hudson Davis the west half of my above said farm by the said Hudson paying the following named heirs as their portion of money that I bequeath unto them, that is to say: my daughter Sarah Jane Turner two hundred and fifty dollars as her balance; to my son Nelson B. Davis two hundred dollars; to my daughter Ann Rebecca Rogers three hundred dollars, and to my grandson Charles Daugherty two hundred dollars when he becomes of age in lieu of his mother's portion, the above money to be paid one fourth per year beginning one year after my decease. The division line of the farms between the said Albert G. Davis and John H. Davis is to be the road that now is in use from the run up to the turn of the lane above the barn, and thence west through the nob field over a stone pile and brier patch to the west line of the farm. Item 5th. I will that what little personal property that I may be in possession of at my decease shall be appraised at fair valuation by three judicious men and a schedule of the same be made out and signed by them and given to my Executor, and also the balance of the tract of land east of the run after my wife's protion is run off to be valued also the same as the personal property and both to be sold at public sale if not otherwise disposed of and the money equally divided between the heirs. If any difficulty or dispute should arise about the division or disposition of any portion of my estate it is my desire that the same be referred for settlement to three honest and capable men for adjustment. I do make constitute and appoint my sons Albert G. Davis and John H. Davis hereby revoking any and all former wills by me at any time made. In witness whereof I, Hanson Davis the Testator have hereunto put my hand and seal to this my last will and testament written on one sheet of paper this 15th day of February in the year of our Lord 1871. Winters Daniel Winters West Virginia Clerk's Office Marshall County Court Aug 1st 1876 A paper writing bearing date February 15th 1871 purporting to be the last will and testament of Hanson Davis late of this county Decd. was this day fully proved before me Thomas Finn, Clerk of the County Court of Marshall County W. Va. in my office according to law by S. R. Davis, Wm. H. Winters and Daniel Winters the subscribing witnesses thereto and is ordered to be recorded. Neither the County nor the Circuit Court being in session and the Clerk having probate jurisdiction & Albert G. Davis & John H. Davis the Executors in said will named who made oath thereto & together with S. R. Davis, Wm H. Winters and Daniel Winters their sueties who qualified as to their sufficience entered into and acknowledged their bond in the penal sum of one thousand dollars conditioned and payable as the law directs. Thereupon certificate is granted the said Albert G. Davis and John H. Davis for obtaining a probate of said will in due form & it is ordered that Albert Davis, John Winters & John Mooney together are appoimted appraisers of the estate of said Decd they being first duly sworn for that purpose.
