Name of County: Pleasants Date of Will: March 10, 1879 Testator: THOMAS BROWSE I, Thomas Browse of the County of Pleasants and State of West Virginia do make this my lsat will and Testament hereby revoking all others I may heretofore have made. First I owe few if any debts but whatever they may be I desire that they may be paid out of my personal estate. Second I give and bequeath to my son Robert Henry Browse and his heirs a certain tract of land & premises situate on the South side of the Osage River Mills County State of Missouri Commonly known by the name of Browse Bend bounded as follows towit. Beginning at a point on the south side of said River in the line of the S.E.S.W. quarter of Section No. 4 Township N41 Range 12 thence with the quarter sectional lines of Section 9 and Section 8 and Section 7 as above to said River Thence down the same with its meanders and bending thereon to the beginning Containing by Estimation 1735 37/100 acres be the same more or less Also, 160 acres of land on Sugar Creek Allso a small Island on the Osage River near the mouth of said Sugar Creek Containing 12 80/100 be the same more or less together with any other lands that I may be entitled to within the said State of Missouri Also the sum of Ten Thousand Dollars hereafter bequeathed to him out of my home place. To Have and to Hold the same however in Trust for the rise and benefit of my Grand Son Herbert Browse Creel Son of my daughter Eliza Jane dec'd. until he shall have attained the age of Twenty five years and given to him the benefit if the interest rents and profits thereof as and whereas he the said Robert Henry may desire fitting until he attains the age of Twenty one Years then the full profits and any accumulation that may have been made until he may attain the said age of Twenty five years and he is fully aythorized and empowered should he think it for the advantage of my said Grand Son to bargain sell or lease the whole of the said land or any part thereof to Convey and make title to the same from the time of my death until he the said Herbert Browse Creel shall have attained the said age of Twenty five years and invest the proceeds thereof in other lands or otherwise to his use and benefit as aforesaid and make such advancements for education or set out in life. If my said Grand Son should die before he attains the full age of twenty five years without children the said property bequeathed as aforesaid shall revert to my own heirs, should he leave children it shall decend to them their heirs and assignees forever - And in the execution of this Trust for the acts in good faith, my son Robert Henry Browse shall not be accountable for losses that may (last word illegible) Third I give and bequeath to my daughter Mary Elizabeth Browse one tract of land situate on the Waters of McKim and Middle Island Creek known as the Jones place containing 700 acres be the same more or less Also the one undivided half of a tract of land held jointly with the Heirs Wm. F. Peterson decd on the run of Willow Island Containing 800 acres be the same more or less being in the County of Pleasants State of West Virginia to her her heirs and assigns forever. I also give and bequeath to my said daughter the sum of Five thousand dollars said sum to be a charge upon the tract of land and premises situate on the Ohio River and known as The Home Place and hereinafter more particularly described. I also give and bequeath unto my said daughter all my Dairy Household and Kitchen furniture at my House at Grape Island with the use of the House premises and adjoining Lands for the term of three years after my death without rent. Fourth I give and devise to my Son Robert Henry his heirs and assigns forever all those certain tracts or parcels of land situate on the Ohio River near Grape Islands and waters of Middle Island Creek and Commonly Known as My Home Farm and on part of which I now reside in the County of Pleasants West Virginia. Consisting of various Continguous tracts acquired by me at different times and containing about three thousand acres be the same more or less together with the island or Islands in the Ohio River known as Bat and Grape Island subject however to the bequest of Three thousand dollars paid to my daughter Mary Elizabeth Browse and the sum of Ten Thousand dollars hereby bequeathed to my Grand Son Herbert Browse Creel which said bequests are made charges or liens on said Land. Fifth I give and bequeath to my Son Robert Henry Browse all the residue of my real and personal estate of Every kind and description whatsoever and wheresoever situated to him his heirs and assigns forever. My Library to be divided between Robert Henry Browse, Mary Elizabeth Browse and Herbert Browse Creel even share and share alike. The Family Grave Yard on my place to be held forever as a burial place for all or any of my descendants. The Legacies devised my Daughter and Grand Son shall be due and payable 2 years after my death with interest of --- my decease. I appoint my son Robt Henry Browse sole executor of this my Last Will and Testament (last couple lines illegible but includes the signature of Thomas Browse). and subscribed by us in the presence of the said Thomas Browse and in the presence of each other. W. Hall and J. B. Townsend two of the subscribing witnesses thereto and thereupon the said Will was admitted to Probate and ordered to be recorded. Teste J. L.
