Name of County: Pleasants Date of Will: March 5, 1870 Testator: JOHN COEN I, John Coen of Pleasants County, Farmer being in good bodily health and of sound and disposing mind and memory calling to mind the frailty and uncertainty of human life and being desirous of settling any worldly affairs and directing how the estate with which it has pleased God to bless me shall be disposed of after my decease. While I have strength and capacity to do so do - make and publish this my last will and testament hereby revoking and making null and void all other last wills and testaments by me heretofore made. And first I communed(?) my immortal being to Him who gave it and my body to the Earth to be buried with little expense or ostentation by my friends or personal representative. And as to my worldly estate and all the property real and personal or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease, I devise bequeath and dispose thereof in the manner following towit 1st My will is that all my Just debts and funeral charges shall be paid by my beloved wife out of my estate as soon after my decease as shall be by convenient 2nd I give devise and bequeath to my beloved wife Elizabeth Coen all my house hold furniture personal property consisting of one chestnut sorrel horse one cow one two year old heifer seven head of hogs - twenty eight head of sheep together with all my real estate consisting of 226 acres of land now lying and being in the County of Pleasants and evidenced by deeds bearing the date one executed by J. M.(?) Stevenson & wife to John Coen on the 24th January 1846 one hundred and sixty five acres (165a) one other deed from W. F. Peterson & wife to same for one hundred and forty six acres bearing date on 3rd day of May 1846. Seventy nine acres was transfered by me to Jonah Coen & same reconveyed by Jonah Coen to John Coen of date 12 October 1864 and of record in the office of the Recorder of Pleasants County Deed Book No 3, pae 5--(?). This constituting my home place to have and to hold the same to her for and during her natural life provided she remains my widow but upon the event she should marry (and will cease to be my widow) if such event should happen then I desire all this property so bequeathed to her by me to be sold, the money arising therefrom to equally divided between all my children ten in number as follows Jonah, Martha Ann, Thomas, Sarah Jane, Elizabeth C., James H., John, Robert, Mary, William H........(Last line illegible)
meaning is and I hereby order and appoint that if any difference, dispute or question or controversy shall be re--- arise or happen concerning any gift bequest matter or thing in this my will given and bequeathed expressed or contained that then no suit or suits in law or equity or other wise shall be brought commenced or prosecuted for and concerning the same but the same shall be refered wholly to the a---- and determination of my friends William C. Hart and John Shingleton both of Pleasants County and what they shall order direct or determine therein shall be binding and conclusive to all and every person and persons therein concerned.
