Mason a resident of the County of Pleasants and State of West Virginia, being of sound mind and memory do hereby publish and declare this to be my last will and testament hereby revoking and making void all former wills made by me at any time. First: I bqueath unto my daughter Malissa G. Mason late. Byers my daughter 35 acres of land including homestead lying and being on Cerry Run and waters of McKim Creek. Beginning at a corner to James Wagner at the Public road and running with line South West thence South East to the Public road to the Watson Mill, thence with the Public road East to a Lynn corner at edge of a run, being the corner to Ira C. Hensworth and James B. Mason, thence north West to a corner between Austin Peters and James B. Mason, thence east with line of Peters and Mason to a stone on the Bank of Public Road, thence with Public road to the beginning , not to exceed thirty five acres. Provided my daughter Malissa G. Mason late Byers furnish me a living and keep one horse on the premises for my individual use when called, "Allso" cows for my benefit so long as needed for my use. Second: the residue of my estate to be divided in the following manner to wit: the cooking stove to remain in the house, the remainder of my property in real and personal to be equally divided including May & Burl M. Byers as full heirs in my estate, "them" being my Grand Children and living in my home and further this will shall have no force until after my demise and funeral expenses is paid any of my heirs who shall become dissatisfied with the distribution of my said will and would attempt to bring into litigacy, shall only receive five dollars and be barred from further interest in my estate. The only child mentioned is Malissa G. who would have been 44 at the time of his death. James B. had at least 2 sons (Josiah J. & William J.) & 5 daughters (Lorena, Mary Ann, Malissa G., Lavera Delpha, & Winnie ). When he died in 1921 his estate inventory was valued $11,017.11 and is also recorded in the courthouse.
