Pleasants County, West Virginia - Will of Jacob Varner WILL OF JACOB VARNER Submitted by Kimberly Volk. Will and testament of Jacob Varner decd In the name of God Amen. I Jacob Varner of Pleasants County West Virginia, Farmer, being weak in bodily health but of sound and disposing mind and memory calling to mind the frailty and uncertainty of human life and being desirous of setting my wordly affairs and directing now the Estate which it has pleased God to bless me shall be disposed of after my decese while I have strength capacity so to do, do make and publish this my last will and testament hereby revoking and making null and void all other last will and testaments by me heretofore made, and first I command my immortal being to Him who gave it and my body to the Earth to be buried with little expence or ostentatiously my frends or personal representations, and as to my worldly Estate and all the property real personal or mixed of which I shall die seized and prossessed or to which I shall be entitled at the time of my decease I devise bequeath and disposed of as follows to wit. First my will is that all my just debts and funeral charges shall be paid by J. L. Varner my executor out of any estate as soon after my decese as shall be by him convenient. I desire that a former division of my farm stand, and further having purchased from my daughter Mary Hichcock her share in said division. Now my will is that my said executor shall rent said parcel of land until he deems best to sell, or divide between himself Ole D. Hichcock and himself equally. Also I will and ordain that the Executor of this my last will and testament or his Executor or Executors for and towards the performance of my said testament shall at this discretion after my decease divide or bargain sell alien infer simple all those lands heretofore mentioned. I do by these presents give to my said Executor and his Executor or Executors full power authority to grant lein bargain sell convey and assume all the said lands to any person of persons and their heirs forever infer simple by all and ? such lawfull ways and means in the law as to any Executor or his Executor or Executors or to his or their council learned in the law shall seem fit or necessary. And I do hereby appoint my son J. L. Varner Executor of this my last will and testament him my said executor to divide said lands heretofore mentioned equally between his self and Ole D. Hichcock or his mother or her heirs should he devise if convenient. I ? them to sell as heretofore mentioned and divide the proceeds as heretofore mentioned in witness when I have hereunto set my hand and seal the 21st day of Decmber 1893. Jacob Varner (seal) The above instrument consisting of one sheet was now subscribed by Jacob Varner the testator in the presents of each of us and was written by J. F. Hart the testator requesting him and was of the same time declared by him to be his last will and testament and we at his request signed our names hereto as attesting witness: J. F. Hart, residing in McKim District, Pleasants County, W. Va. Wm. (his mark) Higgins, residing in McKim District, Pleasants County, W. Va. State of West Virginia Pleasants County, County Court Clerks Office Jauy 31 1895.
