The will was written in and refers to property in Tyler County, Virginia in 1850. The property now lies entirely within the borders of Pleasants County, West Virginia. WM. BAILEY Last Will and Testament The last will and testament of me William Bailey of the County of Tyler and State of Virginia which I publish and declare as followeth, first I direct that my (unkn). Just debts be discharged out of my real estate if my personal property be not sufficient. Item: I give and bequeath to my son Daniel Bailey all that tract or parcel of land situated on McKimm's fork of Middle Island Creek in said county containing eighty four acres purchased of James Stephenson, Esq. now in the possession of my said son. For and during the time of his natural lifeand afterwards to descend equally to the heirs of his body by his first wife, Phebe (?), their heirs and assigns forever it being in (unkn) of Lot No.1 a parcel of land once intended for him and them. Out of the lands that I purchased of Moses Shepherd being a part of a 400 acre survey situated on Middle Island Creek in said county. I make the foIlowing distribution by boundaries as surveyed and marked by Thomas Browse surveyor of said County for the purposes of a division among my children on the 8th and 9th days of March, 1843. Item: I give and bequeath to my son-in-law Henry Wells and husband of my daughter Mary that part of said survey situated on the south side of Middle Island Creek containing twenty one and a half acres to him his heirs and assigns forever received to him some since by a deed of carryance from me. Item: Lot No. 1 containing forty four acres once intended for my son Daniel Bailey. I have since sold to my son Austin Bailey for valuable consideration. Item: Lot No. 2 containing forty three acres. I do give and bequeath unto my son John Bailey his heirs and assigns forever, together with all my right title interest and demand, that I might have as from purchase money of two tracts of land sold and conveyed to Cyrus H. Pickens and secured by a deed of trust on the premises adjoining said Lot No.2. (unkn) ... L. Bailey son of my brother James Bailey his heirs executors administrators or assigns upon trust nonetheless as herein after mentioned for the sole use and benefit of Mariah wife of my son Austin for and during his present coverture and as long as she remains the widow of my said son Austin, and after that (unkn) of his death or second marriage to descend to the heirs of her body and fully begotten to my said son Austin (unkn) and assigns forever. This said Lot No. 3 contains by estimation seventy one acres. Item. Lot No. 4 containing ninety acres I do give and bequeath unto my son Samuel Bailey his heirs and assigns forever. Item. I give and bequeath to my son Austin Bailey the full sum of one dollar to be paid by my executor. Item: I do hereby constitute and appoint my son Samuel Bailey executor of this my last will and testament to receive all my personal property not heretofore devised to pay my funeral expenses. Just debts as far as the same will extend and my heirs, if the said funeral property is not enough. The amount deficient shall be collected equally out of said real estate by my bequeathed. Given under my hand and seal this twenty first day of May 1849 signed sealed and delivered by the said William Bailey as and for his last wiII and testament at his request and in his presence and in presence of us.
