All of the personal estate to be said as is necessary to pay debts and no more. To Alice Hammett all personal estate left after sale. Also all real estate in Pleasants county. To Samuel B., John W., Richard J., Edward, James N., Giles ?essell and Mary Elizabeth Hammett, the proceeds of the sale of the estate, which is to take place after the death of Alice Hammett. Baccom(?), Giles, Robert and Henry, grandsons, one hundred and fifty dollars each from the proceeds of the sale of the estate as directed above. Witnesses by: John Kester, William Kester Date of Codicil July 27, 1859 "I give to my son John W. Hammett all my lands in the County of Wood in the State of Virginia in trust as follows-- He shall bring suit, if he think it advisable, to recover the said lands or any part of them, or may in his discretion compromise with the occupants or claimants of the said lands; or he may if he deem it best sell the title hereby vested in him; having in any action he may take in regard to the said lands, due regard to the interest of all parties intended to be benefitted by this devise. If the said lands or any portion of them shall be recovered, or in any way come to his possession by virtue of this title hereby vested in him, he shall make sale of the same on such terms as to him shall seem most conducive to the interest of all concerned. I direct that one thousand dollars if so much shall be necessary out of the proceeds of my estate in Pleasants County, be applied to defraying of the expenses of such proceedings as shall be had for the recovery of the said lands in Wood County. Said John W. Hammett in full compensation for his trouble in regard to the said lands; and in lieu also of his distributive share shall retain one third of the net proceeds thereof, the remaining two thirds shall be divided between my six other children."
