Declaration For Original Invalid Pension

     On this 2nd day of Aug, A.D. one thousand eight hundred and eighty SEVEN personally appeared before me a clerk of the County Court, a court of record within and for the said County and State aforesaid, EMMERY JACKSON, aged 63 years, a resident of STATE OF MISSOURI ABOUT FIVE MILES FROM MARIONVILLE, County of LAWRENCE State of Mo, who being duly sworn according to law, declares that he is the identical EMMERY JACKSON who entered the service under the name of EMMERY JACKSON on or about the 16" day of FEB 1864 as PVT in company "E" of the 1" regiment of VA CAV commanded by CAPT N. W. WHEELER and was discharged at Wheeling, WVa, on or about the 8" day of JULY, 1865, by reason of close of war, that his personal description is as follows: Age, 63 years; height, 5 feet 9 inches; complexion, dark; hair, black; eyes, blue. That while a member of the organization aforesaid, in the service and in the line of his duty NEAR SHENANDOAH VALLEY in the State of WEST VIRGINIA, on or about the -- day of JAN, 1865, he CONTRACTED DISEASE OF LUNGS FROM EXPOSURE. --- That he was NOT treated in hospitals.... That he has NOT been employed in the the military or naval service otherwise than as stated above except PRIOR SERVICE IN THE 77TH OHIO VOLS from -- That since the 8 day of JULY, A.D. 1865, he has not been employed in the military or naval service of the United States. His occupation has been that of a farmer. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a farmer. That he is now TOTALLY disabled from obtaining his subsistence by manual labor by reason of his injuries above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension role of the United States.

He hereby appoints, with full power of substitution and revocation, GEORGE E. LEMON, of Washington, D.C., his true and lawful attorney to prosecute his claim. That he has NEVER received NOR applied for a pension. That his Post-office Address is MARIONVILLE, county of LAWRENCE, State of Mo

     Respectfully returned to the Commissioner of Pensions.
Emery Jackson, a Pvt. (Rect) of Company "E", 1st Regiment W.Va. Cav. Volunteers, was enrolled on the 16th day of February, 1864, at Wheeling, W.Va. (for 3 yrs), and is reported: on Roll for Mch & Apr/64, (first taken up) and on subsequent Rolls to Feb 28/65, present, Mch & Apl/65, absent, "Removed Camp Pleasant Valley Maryland." May & June/65, present. Muster out Roll of Co. dated at Wheeling W.Va. July 8th 1865, reports him present & mustered out at said date and place.
Return for Jan/65 not on file
Regimental Hospital Records (commencing Feb 1/63 and ending June 16/65) (with breaks) shows him Jan 10/65, with "Rheumatism."
The records of this office furnish no further evidence of disability.

McColloch a clerk of the County Court, a court of record in and for the said County and State aforesaid, EMERY JACKSON, aged 65 years, a resident of MARIONVILLE, County of LAWRENCE State of Missouri, who, being duly sworn according to law, declares that he is the identical EMERY JACKSON who entered the service under the name of EMERY JACKSON on or about the 16" day of FEB 1864 as Private in company "E" of the First regiment of W.Va. Vet. Vol. Cav. commanded by CAPT N. W. WHEELER, and was honorably discharged at Wheeling, WVa, on or about the 8" day of JULY, 1865, by reason of instructions from the war department; that his personal description is as follows: Age, 65 years; height, 5 feet 9 inches; complexion, dark; hair, black; eyes, blue. That he is now suffering from DISEASE OF THE LUNGS AND KIDNEYS.

     In the matter of claim for EMMERY JACKSON
     Personally came before me, a Notary Public in and for aforesaid County and State, EMMERY JACKSON a person of lawful age, who, being duly sworn, declare in relation to the aforesaid case as follows:

     I, Emmery Jackson enlisted in Co. E first Va Cav.      1864- prior to that I served in the 77 Ohio vol. Infantry 18 months - I contract my present disability while in Co E of the 1st WVa cav which is lung disease - which I contracted about 1864 - which assumed a more serious form - I was reported unfit for duty but received no medicine from the physician - after I was discharged I was treated J. C. Weyer deceased at Powhattan Point- Belmont Co. Ohio. I was next treated by Dr. T. H. Hardee - Fanlight, Wetzel Co. WVa. Next by Dr. Yeater of address - same. Next by Dr. J. C. Garrett, Porters Fall WVa - Next by Dr. Wheeler of Stone Co Mo - whose testimony you have in evidence. Next and last by Dr. Carvous who is now treating me. After my discharge I lived near Powhattan Point, Belmont Co. Ohio. Jan. about the 20 1872 I moved to Fanlight- Wetzel Co WVa where I lived till the first of March 1881 when I moved to (near) Porters Fall - Same Co. - Thence to (near) Mariovill Lawrence Co Mo where I now live. My occupation was that of a farmer. As to my disability - Sice the war until 13 years ago I could do about 1/3 of what an able bodied man could do - for 13 years past - I have been able to do no work - most of the time I have been confined to my bed - and look to my friends for the daily rations of life as I have no property of my own.

DECLARATION FOR WIDOW'S PENSION
Act of June 27, 1890

State of Missouri, County of Lawrence, ss:
     On this 23 day of April, A.D. one thousand eight hundred and ninety one personally appeared before me, a Notary Public within and for the county and State aforesaid, FRANEY JACKSON aged 75 years, a resident of the city of Marionville county of Lawrence, State of Missouri, who, being duly sworn according to law, declares that she is the widow of EMERY JACKSON, who enlisted under the name of EMERY KACKSON, at WELLSBURGH, W.Va. on the 16th day of February, A.D. 1864, in Military Service as a Private in Co. E, West Va Cavalry and served at least ninety days in the late War of the Rebellion, in the service of the United States, who was honorably discharged 8th July 1865, and died March 22 1891.
That she was married under the name of FRANEY RICHARDSON to said EMERY JACKSON on the first day of August, 1852 by joseph Carle, at Belmont Co Ohio, there being no legal barrier to said marriage. I was married to JOSHUA RICHARDSON who died 26 march 1850 before my marriage to Emery Jackson.
That she had not remarried since the death of Emery Jackson.

That she has heretofore applied for pension and the number of her former application is that her husband had filed under act of June 27 1890 his No. 6193 85 also under old law.
That she makes this declaration for the purpose of being placed on the pension-roll of the United States under the provisions of the Act of june 27, 1890 and that the Service above named was all the service my husband performed during late war.

She hereby appoints, with full power of substitution and revocation, E. J. Milton(?) of Marionville county of Lawrence, State of Missouri.
