DECLARATION FOR PENSION

On this 7 day of September, A.D., one thousand nine hundred and eight personally appeared before me, a Clerk Circuit Court within and for the county and State aforesaid, James L. Jennings, who, being duly sworn according to law, declares that he is 71 years of age, and a resident of Buckhannon, county of Upshur, State of West Virginia; and that he is the identical person who was enrolled at __________, under the name of James L. Jennings, on the 28 day of January, 1862, as a Sergeant, in Company "C" First Regt., W.Va. Cav. in the services of the United States, in the Civil War, and was honorably discharged at _____________, on the 3rd day of Feb., 1864. That he also served as private in Company "C", 1st Regt. W.Va. Cav, from the third day of Feb. 1864 to July 8, 1865. That he was not employed in the military or naval service of the United States otherwise than as stated above. That his personal description at enlistment was as follows: Height, ____feet ____inches; complextion_____(this is blank), color of eyes______(this is blank); color of hair,_____(this is blank); that his occupation was _____(this is blank); that he was born January 14, 1837, at Prince William Co. Va.
That his several places of residence since leaving the service have been as follows: "most of the time in Upshur Co. W.VA.
That he is ____(this is blank) a pensioner. That he has heretofore applied for a pension. 983,472
That he applied for pension in 1907 and gave age at 65 but have since learned my age is 71. That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of February 6, 1907.
That his post-office address is Buckhannon, County of Upshur, State of West Virginia.

In the matter of pension claim No. 1074689 of James S. Jennings, Private of Company "C" 1st West Va. Cavalry, on this the 8th day of March 1895 personally appeared before me the undersigned Clerk of the Circuit Court of Upshur County, W.G.S. Lotten, whose age is now 52 and whose Post Office address is Buckhannon, West Virginia, and N.G. Mundy, whose age is 57 years and whose Post Office address is Buckhannon, W.Va. and Capt. G. A. Sexton whose age is 54 years and whose Post Office address is Buckhannon, W.Va. who after being by me duly sworn on oath state, in relation to the aforesaid case is as follows, that they have been acquainted with the claimant for at least twenty five years, and they know from a very intimate acquaintance with him that rheumatism and loss of vision are not the result nor were they caused by his own vicious habits, and they further state that this Affidavit in the handwriting of Affidavit Lotten and was prepared by him in the presence of the Affiants Mundy and Sexton and that in making the same they did not use and was not aided or prompted by any written or printed statement prepared or dictated by any other person and not attached as an exhibit to their testimony.

Sir, It seems that my pension papers can't be straightened out. Last May I made application under the last pension law which became a law May 11, 1912. I have no pension since last June till now. You sent me check for 9 dollars when according to the pension law my age and time of service would give me 15 dollars according to the date of my discharge was mustarded in on the 28 of January, 1862. Mustarded out July 8, 1865 at the close of the rebellion. I have been asked some of the most unreasonable questions. Questions that had nothing to do with my pension. You have them all, my father's name, my mother's name, my children, my wife and when I was born. You have it all files cannot the mistake as you see there is mistakes of 60 dollars that means something (illegible).

I received (illegible) of the 29 of January stating that my application could not be found. I think that your mistaken in my application. I made this application last May or June 12 moths ago which gave me 5 more on the month. I am getting $15 my age gave me $20. I am past 76 years at 75. The law gave me $20 per month. I made the application last May or June 12 months. I have your card stating that my application had been received and was on file. I have never made application under the act of May 11, 1912. I am entitled to $5 on the month since last May or June 12 months ago.

On this 13th day of August, A.D. one thousand nine hundred and thirteen, personally appeared before me, a Notary Public, within and for the county and State aforesaid, James L. Jennings, who, being duly sworn according to law, declares that he is 73 years of age, and a resident of Weston, county of Lewis, State of West Va.; and that he is the identical person who was enrolled at Buckhannon, West Va., under the name of James L. Jennings, on the -- day of January, 1862, as a Private, in of Company C, First Regiment of West Virginia Cavalry Vol. in the service of the United States, in the Civil War, and was Honorably Discharged at Wheeling West Va., on the 8th day of July, 1865.
That he also served as Sergeant in Co. C, from Jan. 8, 1862 to Feb. 3, 1864, after which I re-enlisted in same Company, and was mustered out at Wheeling, West Va. with Company on July 8th, 1865.
That he was not employed in the military or naval service of the United States otherwise than as stated above. That his personal description at enlistment was as follows: Height, 6 feet 3 inches; complexion, Light; color of eyes, Gray; color of hair, Brown; that his occupation was Carpenter; that he was born January 14th, 1840, at Fauguire County, Va.

That his several places of residence since leaving the service have been as follows: Buckhannon, West Va. from 1865 to Dec. 16, 1903, at Dayton Home from 1903 to 1911, and have lived at Weston, West Virginia, ever since.
That he is a pensioner under certificate No. 983,472. That he has ____ applied for pension under original No. ________.
That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the act of May 11, 1912.

COUNTY OF LEWIS, to-wit:

I, James L. Jennings, a resident of the County of Lewis and State of West Virginia, and late Sergeant in Co. "C", 1st West Virginia Cavalry, hereby certify that I am unable to produce at this time any family record of my birth, and am unable to produce any such record; that there are no persons living in this locality by which I can show same, as I have only been a resident of this County for the past three years.
I was born on the 14th day of January, 1840, within 16 miles of Fredericksburg, Virginia, in the County of Fauguire: during the years intervening between 1850 and 1860, I resided in Buckhannon, Upshur County, then Virginia, and during said time was residing with my parents, and up to the year 1861.
My father's name was William G. Jennings and my mother's name was Helen A. Jennings, both of which are now deceased.
