DECLARATION FOR PENSION OF CHILDREN UNDER SIXTEEN YEARS OF AGE.

State of Pennsylvania, County of Greene, On this 19th day of June, A.D. one thousand eight hundred and seventy-two personally appeared before me H.H. Lindsey, Prothonotary of the C.P. Court the same being a court of record within and for the county and State aforesaid, Joshua Ackley a resident of Richhill Tp., county of Greene, in the State of Pennsylvania aged 67 years, who, being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Acts of Congress for children under sixteen years of age: That he is the only legal guardian of Foster Etheridge Ackley, the legitimate child and only legitimate child of Lieut. Parker Ackley who volunteered under the name of Parker Ackley at Greene County, Pa., on the _____ day of _________, A.D. 1861, as 1st Lieut. in Co. B. 1st West Va. Cavalry in the war of 1861, who died of a disease contracted in the Army, and in the line of duty known among medical men as Diabetes at Greene County, Pa. on the 17th day of September, A.D. 1869 and who bore at the time of his death the rank of (late) Lieut, in Co. B. 1st W.Va. Cav. that he left a widow surviving Sarah Jane Ackley, who has since remarried on the _____ day of _____ A.D. 18__one Simpson, that the above-named is the only surviving legitimate child of said Lieut. Parker Ackley who was under sixteen years of age at the time of his death, that said child was the issue of said soldier as follows, the date of his birth being hereinafter stated:

Foster Etheridge, of soldier by Sarah Jane Ackley, born January 6th 1863

That the father was married under the name of Parker Ackley to Sarah Jane Farabee, there being no legal barrier to such marriage.


STAMPED: DEPARTMENT OF THE INTERIOR Dec. 4, 1872 PENSION OFFICE

On this 21 day of June A.D. 1872, personally appeared Dr. Silas H. McCracken, a Physician and Surgeon in good and regular standing, who being duly sworn, says: That he attended Lieut. Parker Ackley decd. late of Co. B. 1st West Va. Cavalry, in the capacity of Physician, from a short time after he came home from the Army, until the time of his death. That the said Lieut. Parker Ackley died on the 17th day of September, A.D. 1869, from a disease known among medical men as Diabetis disease and that during all the time the said Ackley was receiving medical attention from him, he was suffering from Diabetis..... from which disease he afterward died. As a Physician he gives the following Diagnosis of the disease, from which Lieut. Parker Ackley decd late of Co. B. 1st W. Va. Cav died, viz: Diabetis complicated with tuburculosis of the lungs, contracted while in the Army as he was considered a healthy man by those who knew him before.


WIDOWS CLAIM FOR PENSION

On this 31st day July, 1873, personally appeared before me, a clerk of a Court of Record in and for the County and State aforesaid, Sarah J. Simpson a resident of Hamilton T.S. in the County of Caldwell and State of Missouri aged ___ years, who being duly sworn, makes the following declaration, in order to obtain the Pension provided by the Act of Congress approved July 14, 1862. That she was the widow of Lieut. Parker Ackley who was a Lieutenant in Company "B" commanded by Capt. H. Farabee in the first Regiment of W.Va. Cav. Vols. in the War of 1861; that her maiden name was Sarah J. Farabee and that she was married to said Parker Ackley on or about the 13th day of September 1861, at Morris Township in the County of Washington and State of Pennsylvania by John Cary and that she knows of no record evidence of said marriage except that already proved.

She Further Declares that said Lieut. Parker Ackley her husband, died of disease contracted while in the service of the United States as aforesaid at Greene County in the State of Pennsylvania on or about the 18th day of September of Diabetis. She also declares that she has remained a widow ever since the death of said Lieut. Parker Ackley to the 1st day of March, 1871 when she was married to Henry Simpson and that she has not in any manner been engaged in, or aided or abetted, the rebellion in the United States; and she hereby appoints J.P. Teagarden of Waynesburg Pa. as her lawful Attorney, with power of substitution, and authorizes him to present and prosecute this claim, and to receive her pension certificates. The following is the name, date of birth and place of residence of all the children of her deceased husband who were under sixteen years of age at the time of his death --- Foster Etheridge Ackley, born on the Seventh day of January A.D. 1863 in the county of Washington , State of Pennsylvania, that the said Foster Etheridge Ackley is the only issue of said marriage. My Post Office address is: Hamilton, Caldwell Co., Mo.

Also personally appeared before me Samuel Farabee and Harvey Farabee residents of Hamilton, Caldwell County, and State of Missouri to me well known as credible persons, who being duly sworn, declare, that they were present and saw said Sarah J. Simpson sign her name to the foregoing declaration, and that they have every reason to believe, from the appearance of said applicant, and their acquaintance with her, that she is the identical person she represents herself to be, and know that said deceased recognized said applicant as his lawful wife, and that she was so recognized by the community in which they resided; and that they have no interest, direct or indirect, in the prosecution of this claim.

On this 12th day of August A.D. 1873 formally appeared before one H.C. Pollock Clerk of the Court of Quarter Sessions for the County and State aforesaid, S. A. Houston, a person whom I certify to be respectable and entitled to credit, who by me duly affirmed according to law, saith that Foster E. Ackley was the only child of Parker Ackley dec'd (late First Lieut. of Company "B" of the 1st W.Va. Cav. Vols.) that he was known to be the father of said Parker. And that I am not interested in the prosecution of the claim of said child for Pension.

McDonald, clerk of the Common Pleas Court the same being a Court of record within and for the county and State aforesaid. Rev. John Cary, a person whom I certify to be respectable and entitled to credit, who being by me duly sworn according to law, says that he was the officiating minister at the marriage of Sarah Jane Farabee to Parker Ackley, late a Lieutenent of Company "B" 1st Reg. W.Va. Cav. Vols. That he married them on the 13th day of September A.D. one thousand Eight hundred and Sixty one, and that there was no legal ___?___ in the way of said marriage. That he has no interest, direct or indirect in the prosecution of the claim of the minor child of the said Parker Ackley for Pension.

On the fourteenth day of November A.D. 1874, personally appeared before me, John Birch, a Justice of the Peace within and for the County and State aforesaid , Dr.Silas H. McCracken, a physician and surgeon in good and regular standing and a person whom I testify to be reputable and entitled to credit he being duly and formally sworn according to law, says that he was called to attend Parker Ackley late a Lieutenant in Company "B" 1st Reg. West Va. Cav. Vols. While he was at home on furlough or leave of absence, I found him suffering from a severe cold, and his lungs much influensed, he had had the measles and had taken a severe cold which had settled on his lungs. He had a severe and troublesome cough and was very much debilited. I advised him to leave the Army and take more care of himself or he might not fully recover. In the course of a month or so, he so far recovered as to be able to return to the service. In a short time he was again taken down when he resigned or was discharged and came home. I was again called to see him immediately after he arrived at home. I found him suffering from chronic diarrhea, his lungs were still influensed an he had a bad cough, all the evil effect of the measles was still in his system he was very much emaciative and was suffering from general debility. This was, I believe, in the Spring of 1862, do not remember the exact time. Diarrhea still continued to return to him until death relieved him. He was troubled with bronchial affliction when he arrived at home the last time. It's course was slow but sure, Pulmonary consumption then followed in the natural course of the disease. I treated him from the time of his discharge to the date of his death. The disease or rather diseases were continous from the time of his discharge to the date of his death. He would sometimes rally and seem much better for a time. But his constitution was broken and the recovery would be but temporary. Consumption was produced by exposure and the diseases he had contracted while in the Army. And in fact he had incipient consumption when he came home from the Army, which slowly but surey made its ? upon the general system. I was acquainted with the said soldier before he entered the service and in my opinion was free from any of said diseases. He was a hale hearty man. That said diseases were not to the best of my knowledge ? . That I have no interest in the proseution of the claim of his child for pension.

Know all men by these presents that I, Joshua Ackley guardian of Foster E. Ackley, a minor child of Parker Ackley decd. do hereby constitute, appoint and empower J. P. Teagarden of Waynesburg Pa. my true and lawful attorney to prosecute the claim No. 204.787 of the minor child of Parker Ackley decd for pension in place of J. Jackson Purman who has withdrawn from the prosecution of said claim, on the same conditions and with same powers and same fees as was per contract with said J. Jackson Purman.

Pollock, Clerk of Court of Quarter Sessions within and for said county, do certify that Stephen Knight Esq., before whom the foregoing acknowledgement was made was, at the time of taking the same, and still is, an acting Justice of the Peace within and for said County, duly commissioned and sworn; and that the signature purporting to be his, to said acknowledgement is his genuine signature.
