DAVID CUNNINGHAM - War of 1812


BOUNTY LAND APPLICATION, 31 March 1855

State of Virginia}
County of Harrison}

On this 31st day of March AD one thousand eight hundred and fifty-five personally appeared before me a justice of the peace within and for the county and state aforesaid DAVID CUNNINGHAM aged sixty years who being duly sworn according to law declares that he is the identical DAVID CUNNINGHAM who was a PRIVATE in the company commanded by CAPTAIN GABRIEL T. WILKINSON in the REGIMENT OF VIRGINIA MILITIA commanded by COL. WALTER STREET in the war with Great Britain declared by the United States on the 18th day of June 1812 for the the TERM OF SIX MONTHS and that he continued in actual service in said war for fourteen days; that he has heretofore made an application for bounty land under the Act of Congress approved September 28th 1850 and received a land warrant. No.... for Eighty acres which he has since legally disposed of and cannot now return.

He makes this declaration for the purpose of obtaining the additional bounty land to which he may be entitled under the Act of Congress approved March 3, 1855; and he hereby constitutes and appoints NORVAL LEWIS of Clarksburg Virginia his attorney to prosecute his claim and receive his warrant. He also declares that he has never applied for nor received under this or any other act of Congress any bounty land warrant except the one above mentioned.

DUNNINGTON residents of Harrison County in the State of Virginia upon our oaths declare that the foregoing declaration was signed and acknowledged by DAVID CUNNINGHAM in our presence and that we believe from the appearance and statements of the applicant that he is the identical person he represents himself to be. CLAIM OF WIDOW FOR SERVICE PENSION,

On this EIGHTEENTH day of OCTOBER, A.D. one thousand eight hundred and SEVENTY EIGHT, personally appeared before me, JOHN BLERANE CLERK OF COUNTY COURT, the same being a court of record within and for the County and State aforesaid, (1) REBECCA CUNNINGHAM, aged 56 years, a resident of MARION COUNTY, in the State of WEST VIRGINIA, who being duly sworn according to law, declares that she is the widow of (2) DAVID CUNNINGHAM deceased, who was the identical (3) DAVID CUNNINGHAM, who served under the name of (4) DAVID CUNNINGHAM as a (5) private in the Company commanded by Captain GABE WILKINSON....in the War of 1812; that her said husband (7) VOLUNTEERED at MORGANTOWN, WVa on or about A. D. 1813...., and continued in actual service in said war for the term of (8) ONE YEAR AT LEAST and whose services terminated, by reason of HONORABLE DISCHARGE at NORFOLK Va....A.D. 1815. She further states that the following is a full description of her said husband at the time of his enlistment, viz:(10) HE WAS A LOW HEAVY SET MAN WITH BLACK HAIR BLUE EYES FAIR COMPLEXION. She further states that she was married to the said DAVID CUNNINGHAM,....in the county of HARRISON, and in the State of then VIRGINIA NOW WVa, on....FEBRUARY A.D. 1861 by one REV. GOOSEMAN, who was a (12) MINISTER OF METHODIST CHURCH; and that her name before her said marriage was REBECCA KELLY, and that she has not remarried since the death of said DAVID CUNNINGHAM; and she further states that (13) HER SAID HUSBAND WAS MARRIED TO.... WHO DIED ABOUT....AND NEXT TO JENNIE HANNAS WHO DIED ABOUT....AND THAT SHE WAS PREVIOUSLY MARRIED TO DAVID KELLY WHO DIED IN THE YEAR A. D. 1850 and that her said husband (14) DAVID CUNNINGHAM, died at MARION COUNTY, in the State of WEST VIRGINIA,.... day of FEBRUARY A. D. 1865; and she further declares that the following have been places of residence of herself and her said husband since the date of his discharge from the Army, viz: (15) APART OF THE TIME IN HARRISON COUNTY WEST VIRGINIA AND THE REST OF THE TIME IN MARION COUNTY WEST VIRGINIA. She makes this declaration for the purpose of obtaining the Pension to which she may be entitled under Section 4736 to 4740, inclusive, Revised Statutes, and the Act of March 9, 1878, and hereby appoints, with full powers of substitution and revocation, R. W. WALKER, OF WASHINGTON, D.C., her true and lawful attorney to prosecute her claim. And she further declares that she has heretofore made NO application for (16) PENSION and that her residence is county of MARION State of WEST VIRGINIA, and that her post office address is GLOVERS GAP MARION COUNTY WEST VIRGINIA.

On this THIRD day of SEPTEMBER A.D. one thousand eight hundred and EIGHTY THREE personally appeared before me JAMES MONROE, CLERK OF COUNTY COURT, the same being a Court of Record within and for the County and State aforesaid, (1) REBECCA CUNNINGHAM aged 69 years, a resident of NEAR FARMINGTON in the state of WEST VIRGINIA who being duly sworn according to law, declares that she is the widow of (2) DAVID CUNNINGHAM deceased, who was the identical (3) DAVID CUNNINGHAM who served under the name of (4) DAVID CUNNINGHAM as a (5) PRIVATE in the Company commanded by Captain GABRIEL T. WILKINSON 5TH Regiment VIRGINIA MILITIA commanded by COL WM Y. STREETS in the war of 1812; that her said husband (6) ENLISTED at BRIDGEPORT, VIRGINIA on or about the 3RD day of AUGUST A.D. 1814 for the term of 6 MONTHS and continued in actual service in said war for the term of SIX MONTHS, and whose services terminated by reason of HONORABLE DISCHARGE at NORFOLK, VIRGINIA on the 8TH day of FEBRUARY A.D. 1815. She further states that the following is a full description of her said husband at the time of his enlistment, viz: (9) AGE 18 YEARS - HEIGHT FIVE FEET 6 INCHES EYES BLUE- HAIR DARK. She further states that she was married to the said DAVID CUNNINGHAM at the county of HARRISON and in the State of WEST VIRGINIA on the 14TH day of FEBRUARY A.D. 1860 by one (10) NIXON POTTS, who was a (11) MINISTER OF THE GOSPEL and that her name before her said marriage was REBECCA KELLEY nee REBECCA BOLINGER and that she has not remaried since the death of said soldier; and she further states that (12) HER SAID HUSBAND HAD BEEN PREVIOUSLY MARRIED AND WAS A WIDOWER. THAT AFFIANT WAS A WIDOW WHEN SHE MARRIED CUNNINGHAM and that her said husband since the date of his discharge from the army, viz: (14) THAT HER SAID HUSBAND LIVED IN HARRISON COUNTY VIRGINIA AFTERWARD WEST VIRGINIA FROM DISCHARGE UNTIL 1864 AND FROM 1864 UNTIL HIS DEATH IN 1865 IN MARION COUNTY WEST VIRGINIA. THAT AFFIANT ALSO RESIDED IN HARRISON AND MARION COUNTIES DURING THE PERIOD FROM HER BIRTH TO THE PRESENT TIME-.

She makes this declaration for the purpose of obtaining the Pension to which she may be entitled under the provisions of Sections 4763 to 4740, inclusive, Revised Statutes, and the Act of March 9, 1878, and hereby constitutes amd appoints, with full powers of substitution and revocation ALEXANDER C. MOORE her true and lawful attorney to prosecute her claim. And she further declares that she has heretofore made __ application for (15) PENSION No. 34484 WHICH APPLICATION SHE HAS BEEN INFORMED WAS INFORMAL. THE ....TO SAID CLAIM TO SUPPORT THIS CLAIM FOR PENSION and that her residence is NEAR FARMINGTON County of MARION State of WEST VIRGINIA and that her post office address is FARMINGTON, MARION COUNTY WEST VIRGINIA.

On this 3rd day of September 1883, personally appeared before me James Monroe, Clerk of the County Court of said County - ELIZABETH SWIGER aged 74 years- whose Post Office address is Sardis, Harrison County West Virginia, and OLIVE WILLIAMS aged 61 years, whose Post Office address is Wolfs Summit, Harrison County West Virginia, credible persons, who being by me duly sworn according to law depose and say. That affiants were well acquainted with the late DAVID CUNNINGHAM, who served as a PRIVATE in CAPT GABRIEL T. WILKINSONs Company of the 5th Regiment Virginia Militia in the War of 1812.- Who DIED in the County of MARION in the State of West Virginia on the 22ND DAY OF MARCH 1865. That affiants are also well acquainted with Rebecca Cunningham who is the Widow of the said DAVID CUNNINGHAM and now resides near FARMINGTON MARION County West Virginia. That the said REBECCA CUNNINGHAM has not remarried since the death of her said husband DAVID CUNNINGHAM but still continues his widow. That their acquaintance with said REBECCA CUNNINGHAM is such that if she had of remarried they would have known it.-

That the said DAVID CUNNINGHAM was married three times-. That his first wife's name was Sarah Randall to whom he was married about the year 1818, who died on or about the 14th day of February 1846.- That affiants well remember said DAVID CUNNINGHAMs second wife JENNETTE HANNAH before marriage. That said CUNNINGHAM married her on or about the __ day of ....18.. and that the said JENNETTE CUNNINGHAM died on or about the 24th day of June 1859. That affiants both attended the funeral of the said SARAH CUNNINGHAM said DAVID CUNNINGHAMs first wife.- That they both recollected the death of the said JENNETTE CUNNINGHAM said DAVID CUNNINGHAMs second wife. That affiant ELIZABETH SWIGER, attended her funeral- That the said DAVID CUNNINGHAM for his third wife married in the year 1860 one REBECCA KELLEY, and lived with her until his death on the 22ND DAY OF MARCH 1865 - That the said REBECCA CUNNINGHAM is still living and remains his widow-. And they further declare that they have no interest in the claim of the said REBECCA CUNNINGHAM widow of DAVID CUNNINGHAM a Pension from the United States- (Signature of Olive Williams; Elizabeth Swiger X mark; witnesses, S. In the matter of Rebecca Cunningham widow of David Cunningham who is an applicant for pension on this the 8th day of march 1884 came personally before me B. F. Charlton a Notary Public in and for said County JAMES H. FURBEE aged 55 years a resident of Mannington Marion County to me well known to be reputable and entitled to credit and being by me duly sworn says that he was acquainted with David Kelly former husband of the said Rebecca Cunningham who then lived on Pawpaw Creek in Marion County that he was present at his wake after his death and saw him after death this was in the year 1848 or 1849 and knew him very well for some time prior to his death and he further says that he has no interest in the prosecution of this claim for pension.

David's Certificate of Discharge from service in the War of 1812 was included in the application for the additional bounty land.

Olive Williams, who provided an affidavit for Rebecca's pension application, was a daughter of David and first wife, Sarah Randall. Olive Cunningham married Charles Williams 19 April 1853, per Harrison County, WA marriage book by Wes Cochran. Relationship to Elizabeth Swiger unknown.

Elizabeth Swiger, the deponent mentioned in this application, was the mother of Rebecca Swiger Cunningham, the wife of David's son, John Jackson Cunningham.

Jennette Hannah Cunningham, the second wife of David, died 23 June 1860, per Harrison County, WV Deaths book by Patricia B. Hickman.
